BURGINS HERRINGTON LAKE RV PARK RENTAL AGREEMENT

This Rental Agreement (“Agreement”) is made between Burgin’s Herrington Lake RV Park, legally registered as Burgin RV Park LLC (“Park”), and the undersigned individual(s) (“Renter”) for use of an RV lot located at the Park.
RENTAL TERMS AND RATES:
Monthly Rentals:
- Rate: $600 per month.
- Electric usage is billed separately, and an invoice will be sent monthly.
- Rentals exceeding 30 days are exempt from Kentucky sales tax.
- Monthly rentals require a recurring payment method on file.
- Cancellation Policy: 30 days’ notice required for cancellations.
- Energy Surcharge: $150/mo
Add-On Charges:
- Horse stalls are available at $20 per night (reservation required).
- Each lot allows 2 vehicles; additional vehicles must be approved by management and may be removed if unapproved.
- MOVE-OUT POLICY:
- For rentals exceeding 30 days, a minimum of 7 days’ notice must be given before moving out.
- Failure to provide notice may result in continued billing and/or forfeiture of any applicable deposit.
- LIABILITY WAIVER:
- Renter agrees to hold harmless Burgin’s Lake RV Park LLC, its owners, staff, and affiliates from any injuries, damages, theft, losses, accidents, or weather-related events occurring on or around the property.
- The Park assumes no liability for weather-related events, damages, or losses.
- PROPERTY RULES:
- Trash: Renter must dispose of all garbage properly; no trash may be left outside the RV.
- Pets: Pets must be leashed at all times, and pet waste must be picked up immediately.
- Quiet Hours: 10 PM to 7 AM. No loud music or disruptive behavior allowed.
- RV Condition: Only self-contained, well-maintained RVs are permitted. Management reserves the right to deny entry or require removal of non-compliant units.
- Sewer/Water Hookup: Proper sewer collars must be used.
- Fires: Permitted only in approved fire pits and must be fully extinguished before leaving unattended.
- Subletting: Subletting or renting out the lot without prior written consent is prohibited.
- Horse Stalls: Available by reservation only.
- Permanent Structures: Any permanent structures, including porches or storage sheds, must be approved by management, conform to park appearance standards, and be installed by Park management.
- Illegal Substances and Firearms: No illegal substances or firearms are permitted on Park property.
- PAYMENTS & BILLING:
- All payments are due in advance.
- Monthly and annual renters must maintain a valid credit/debit card on file for automatic billing of rental fees and utilities.
- Late payments may result in removal from the park and/or forfeiture of remaining rental terms.
- GATED ACCESS & SECURITY:
- Renter will receive a gate code or access device, which must not be shared.
- The Park is not responsible for lost or stolen items. Renters are responsible for securing their own property.
- TERMINATION:
- The Park reserves the right to terminate this Agreement at any time for violations of park rules, non-payment, or disruptive behavior.
- No refunds will be issued for evictions resulting from Renter misconduct.
- Renters may terminate this Agreement by providing a minimum of 30 days’ written notice.
- GOVERNING LAW:
- This Agreement shall be governed by and interpreted according to the laws of the Commonwealth of Kentucky.
- Venue for any disputes shall be exclusively in Mercer County, Kentucky.
9. ACKNOWLEDGMENT: By signing below, the Renter acknowledges they have read, understood, and agreed to abide by all terms and conditions outlined in this Agreement.
